In December 2018, the Supreme Court of Justice of the Nation (Suprema Corte de Justicia de la Nación – SCJN) of Mexico determined that it was unconstitutional for employers to not be required to register domestic workers (DWs) with the Mexican Social Security Institute (Instituto Mexicano del Seguro Social – IMSS). In line with that judgment, in April 2019 the IMSS implemented the Pilot Programme for the Incorporation of DWs into the Compulsory Scheme of the IMSS (hereinafter the PP) through a simplified system for the incorporation and payment of worker and employer contributions to reduce transaction costs for employers and DWs as much as possible, and to encourage the transition of the latter group to formal employment relations.
Over the course of three years at the most, the challenge consists of securing “effective, robust and adequate” social security coverage for domestic workers.
