Removal of provisions to fine employers with excessive disability claims

Legislation has been enacted to rescind the program under which fines can be imposed on employers with excessive disability claims. This follows a ruling by the high court for social security, the Centrale Raad van Beroep, which found in favour of 17 employers who had been fined for misuse of the system.

The legislation to rescind the program of fines will be effective retroactively from 1 July 1995.

The legislation to impose fines on employers had originally been instituted in March 1992 to discourage employers from removing employees by encouraging them to apply for disability benefits.
